Don't Rely on the "Luck of the Irish"

By Marty Elberg · 1 min read

I hope you find a pot of gold at the end of the rainbow, but "luck" is not a valid legal strategy.

I see people all the time who say, "I'll just let my kids figure it out. They're lucky they're getting anything at all!" This is the legal equivalent of throwing a grenade into a room and closing the door. If you don't have a plan, you're gambling with your family's harmony. I've seen siblings stop speaking for decades over a set of silver spoons. Don't leave your legacy to luck.

Hold a family meeting

It doesn't need to include dollar amounts. Just clarity about your values and wishes.

  • Who your executor and agents are
  • Where your documents are located
  • What you want for medical care or guardianship
  • Why you've made the choices you have

Keep it short (20 to 30 minutes), use neutral language ("this is to help everyone"), and emphasize love and clarity, not control.

Check for "lapse" issues

What happens if your first-choice heir dies before you do? Does it go to their kids or your other children? Your plan should say.
